Rental Policies and Terms

1. CHECK-IN TIME IS AFTER 3 P.M. PST AND CHECK-OUT IS 10 A.M. PST.NO Early Check-in or late check-out.

2. All units are NON SMOKING indoors. Patio/outdoor smoking permitted if stated in specific property desc;x>ription on PopularVacationRentals.net.

3. PETS - Pets are permitted in rental units. Pet Damage fees and extra cleaning charges are accounted for in the same manner as other damages.

4. DAMAGE/RESERVATION DEPOSIT- A refundable damage deposit of $1000 is required. This must be received when paying your accommodation balance, before your arrival date. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met. a. No damage is done to unit or its contents, beyond normal wear and tear. b. No charges are incurred due to contraband, pet damages or collection of rents or services rendered during the stay. c. All debris, rubbish and discards are placed in dumpster. d. All keys are left in the lock-box (if applicable) and unit is left locked. e. All charges accrued during the stay are paid prior to departure. f. No linens are lost or damaged. g. NO Early check-in or late check-out. h. Parking stalls have not received any extraordinary damage such as oil stains. i. The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by the property management company.

5. PAYMENT – An advance payment equal to 20% of the rental rate is required to reserve your stay. The advance payment will be applied toward the room rent. Please make payments using the online payment system. Personal checks or in-person payments are not accepted. The advance payment is not a damage deposit. An invoice for the BALANCE OF RENT will be sent electronically after your advance/reservation payment has been made and is due fourteen (14) days before your arrival date.

6. CANCELLATIONS – A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit.

7. MONTHLY RESERVATION CANCELLATIONS – Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in.

8. MAXIMUM OCCUPANCY- The maximum number of guests for any apartment suite is limited to ten (10) persons. No additional charge or per person or per night for additional guests will be assessed.

9. PEACEFUL AND LAWFUL OCCUPATION - The Occupant, their guests and invitees, shall not disturb, annoy, endanger or interfere with other occupants of the rented premises or the neighbors of the rented premises, nor shall the Occupant, their guests and invitees, use the premises for any unlawful purposes, including but not limited to, using, manufacturing, selling, providing, storing or transporting illicit drugs or other contraband, or violate any Federal, State or local law or ordinance, including, but not limited to, the use of alcohol by minors or commit waste or a nuisance upon the rented premises. The Occupants shall be responsible to pay any fines, assessments or charges imposed by any public authorities due to any violation(s) of any rules, regulations, laws or ordinances by the Occupant, their guests or invitees. Should any Occupant, their guests and invitees, cause a disturbance resulting in police action, this rental may be terminated immediately and no refund of rental monies or deposits shall be made.

9. ALL PROPERTIES REQUIRES AT LEAST A THREE (3) NIGHT MINIMUM STAY. Longer minimum stays are required during summer and holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.

10. INCLUSIVE FEES – Rates include a one-time cleaning fee. Amenity fees are included in the rental rate.

11. NO DAILY MAID SERVICE – While linens and bath towels are included in the unit, daily maid service is not included in the rental rate however is available at an additional rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units.

12. RATE CHANGES – Rates subject to change without notice.

13. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

14. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.

15. PARKING – Parking stalls are located inside the garage. Renters may be required to display parking passes on city streets. Failure to display may result in towing of vehicle at owner's expense.

16. NO TRAVEL/STORM POLICY – No refunds will be given unless: a. The National Weather Service orders mandatory evacuations in a "Flood Warning area" and/or b. A "mandatory evacuation order has been given for the Flood Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Flood Warning," area, we will refund: 1. Any unused portion of rent from a guest currently registered, 2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and 3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Flood Warning" period.

17. LEGAL DISPUTES - If any legal action or proceeding arising with respect to this rental agreement is brought by either party, the prevailing party shall be entitled to receive from the other party, in addition to any other relief that may be granted, the reasonable fees, costs, and expenses incurred in the action or proceeding by the prevailing party. It is agreed that in the event of any legal dispute, the laws of the State of California shall apply.
